1. Acceptance of Terms
By accessing or using the TextScore platform (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not accept all of these terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
2. User Conduct and Responsibilities
You are solely responsible for all text, data, and other content that you submit to the Service. You agree not to use the Service to analyze or distribute any content that:
- Is illegal, fraudulent, harmful, or encourages unlawful activity.
- Is harassing, defamatory, abusive, or hateful toward any individual or group.
- Contains private or personally identifiable information of third parties without their explicit consent.
- Infringes on any patent, trademark, trade secret, copyright, or other intellectual property right of any party.
Furthermore, you agree not to:
- Attempt to bypass any security measures, access controls, or rate limits we implement.
- Use any automated system (such as a bot or scraper) to access the Service in a manner that sends more request messages to our servers than a human can reasonably produce in the same period.
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
3. Disclaimers and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. TextScore makes no warranties, express or implied, regarding the accuracy, reliability, or suitability of the analysis provided. The feedback and scores generated are for informational purposes only and should not be considered definitive, professional advice, or a guarantee of any specific outcome.
To the fullest extent permitted by law, in no event shall TextScore, its affiliates, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.
4. Intellectual Property
You retain all ownership rights to the content you submit for analysis. By using features that involve anonymous feedback (such as the "Help Us Improve" button), you grant TextScore a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, and analyze your submitted content and its corresponding analysis report solely for the purpose of training our models and improving the Service.
All other aspects of the Service, including but not limited to the TextScore name, logo, branding, user interface, source code, and technology, are the exclusive property of TextScore and its licensors.
5. Rate Limits and Fair Use
To ensure equitable access for all users, the Service is subject to rate limits. Currently, each IP address is limited to 5 analyses per day for general use. AI-powered features may have separate, more restrictive limits. These limits are subject to change at our discretion. Attempts to circumvent these limits may result in a temporary or permanent suspension of your access to the Service.
6. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the jurisdiction in which TextScore is headquartered, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of said jurisdiction.
